These terms apply to all orders placed via this website and to the use of the SunPlot app. Provider:
The order takes place in four steps: choosing the product, checking the details (can be changed until you click “Continue to payment”), payment via our payment service provider Stripe, confirmation by email. The presentation of the products on the website does not constitute a binding offer. By completing the payment, you make an offer; the contract is concluded with our order confirmation by email, at the latest upon delivery of the report or the licence code. If we cannot accept an order, for example because insufficient data is available for the address, we refund the amount paid in full.
For a single report, the property address must be selected from the list of suggestions; it does not have to be your own home address. You are responsible for the accuracy of the address and the email address. Sending a photo with the order is optional; the photo is only used on the title page of the report.
The prices shown on the website at the time of the order apply, in Swiss francs including 8.1 % VAT. Payment is made via Stripe (credit card, debit card, TWINT as well as Apple Pay and Google Pay, where available). Subscriptions are charged monthly or annually in advance and renew automatically for the same period until they are cancelled. Price changes only apply from the next subscription period; we announce them by email at least 30 days in advance, and you can cancel the subscription up to the date of the change, effective at the end of the current period.
Voucher and free codes: A code is valid for the service and duration stated on it. It is personal, non-transferable and cannot be combined with other promotions; it cannot be exchanged for cash. If no expiry date is stated, a code can be redeemed for 12 months from issue. Codes from a subscription end with the subscription. In the event of passing on, multiple use or other misuse, we may block a code. For reports created with a code, clause 8 applies with the proviso that we only rectify or recreate the report and do not refund anything.
The single report is created after receipt of payment and delivered by email as a link, usually within one working day. The link is valid for 6 months, after which the report is deleted from our server; if you want to keep it longer, download it as a file beforehand. The licence code for subscriptions is sent by email immediately after payment. All services are provided digitally; there is no physical delivery.
Cancellation by you: Subscriptions can be cancelled by email at any time, effective at the end of the current billing period (month or year), with no minimum term. Access remains until the end of the paid period; in this case, periods already paid for are not refunded pro rata.
Cancellation by us: We may cancel a subscription at any time with effect from a date we determine, for example if we discontinue or adapt the service or if a data source ceases to be available (clause 9). We notify you of the cancellation and the date by email to the address given when ordering. The subscription remains fully usable until the cancellation date.
Pro rata settlement: If we cancel, or if the subscription ends because a data source ceases to be available, you only owe the subscription fee up to the cancellation or termination date. The current period, paid in advance, is settled to the day: amount paid divided by the number of days in the period, multiplied by the days used. We refund the remainder within 30 days to the original payment method; we also refund additional reports that have been paid for but not yet used. Reports already created remain usable in accordance with clause 7. There are no further claims arising from the cancellation, in particular for damages or reimbursement of consequential costs, to the extent permitted by law.
Termination for good cause: Either party may terminate the subscription without notice for good cause; for us, this applies in particular in the event of a breach of clause 7 (such as passing on the licence code or offering reports as one’s own product). In this case, there is no entitlement to a refund.
The reports are calculated automatically from publicly accessible geodata of the Confederation and the cantons (including swisstopo, FOEN, SFOE, ARE, FEDRO, FSO, FOT, FOCA, FOC, OFCOM, ElCom, MeteoSwiss and the official cadastral surveying of the cantons) as well as from OpenStreetMap, the timetable from opentransportdata.swiss and the PVGIS radiation data of the European Commission. The full list of datasets with supplier, terms of use and link is available at sunplot.ch/daten and is continuously updated. Hours of sunshine and shadows are determined geometrically from terrain, building and vegetation data, without clouds and without weather. They are model values reflecting the status of the respective datasets: new buildings, felled or grown trees and errors in the source data may be missing or differ. The Confederation and the cantons give no warranty for their data, and we cannot verify it. Where a building is missing from the model (for example a new building constructed since the data was captured), its height is derived from the laser surface model; the results there are less accurate.
The report is not official information, not an expert opinion and not an on-site measurement. It does not replace a viewing, enquiries with the municipality or canton (in particular regarding natural hazards and building law) or professional advice. You make purchase, rental, construction and investment decisions on your own responsibility.
Information on construction projects, building applications and planning in the area is a snapshot taken from public registers and publications as at the stated date of the query. It may be incomplete, delayed or incorrect, and not every project is publicly recorded. The absence of an entry does not mean that nothing is planned. Only information from the competent authorities is authoritative.
You receive a non-exclusive right, unlimited in time, to use the report for your own purposes, in particular for purchase or rental decisions and in sales or letting documents, and to pass it on to interested parties, tenants or advisers. When creating a report in the app, subscription customers may omit sections, individual maps and view images and insert their own texts, logo and photo. The calculated values, maps and images as well as the legal notices and source references in the report may not be altered or removed; a finished report may not be altered afterwards. The creator is responsible for their own additions and for omitted content; we are not liable for statements that arise only through additions, omissions or subsequent changes. The subscription customer may also pass on reports for a fee, for example as part of a dossier, a consultation or a valuation, and design them in the app with their own logo, their own colours and their own texts; the reference to SunPlot as the creator as well as the source references and legal notices remain in place. The following are not permitted: offering SunPlot reports as your own product under your own name, systematically extracting the data and using the app beyond the booked quota, for example by passing on the licence code. The surroundings data comes from OpenStreetMap (© OpenStreetMap contributors, ODbL); the corresponding notice in the report may not be removed.
Software and data. The SunPlot app, the report server, the geodata we prepare and the design of the reports are protected by copyright (Swiss Copyright Act) and remain our property or that of our licensors. With a purchase or subscription you acquire only the right to use the report described in this clause. You may not copy, replicate or modify the app and the server, retrieve data automatically via the app’s interfaces, circumvent access or quota checks, or take over the result of our work into an offering of your own (Art. 5 Swiss Unfair Competition Act), except where mandatory law provides otherwise. In case of infringement we may block access; further claims remain reserved.
Third-party data in the report (clause 6) is additionally subject to the terms of use and licences of its suppliers; these also apply to recipients of the report. This clause 7 does not restrict the rights that such terms or licences grant to every user in respect of this data, for example for data under CC BY 4.0 or CC BY-SA 4.0 (such as data from the PLR cadastre of the cantons of Basel-Stadt and Valais) or for data that may only be passed on under the same conditions (such as data from the PLR cadastre of the cantons of Schwyz and Glarus). Which terms apply to which data is stated in the source references in the report and at sunplot.ch/daten.
Subscription customers who pass on reports to their own customers are themselves responsible towards them. No contractual relationship and no relationship of trust arises between us and the recipients; the subscription customer informs the recipients about the nature of the report in accordance with clause 6. The subscription customer indemnifies us against third-party claims arising from the passing on or use of their reports, including reasonable costs of legal defence, unless we acted intentionally or with gross negligence.
There is no statutory right of withdrawal. The order is binding upon payment; the creation of the report or the activation of the subscription begins immediately. Insofar as a right of withdrawal for digital content exists at your place of residence, by placing the order you expressly request that we begin the creation or activation immediately, and you confirm that you thereby lose your right of withdrawal.
Defect in the report, rectification: If something in the report is not right, contact us by email within 14 days of receiving the link and describe the defect. We review the case and rectify it: we correct the affected maps or chapters or recreate the report. This also applies if only individual maps or chapters are affected; the rectified report replaces the previous one under the same link. A defect exists if the report objectively fails to fulfil its purpose at the ordered address, in particular if (a) the address or the building has been assigned incorrectly despite correct order details, (b) the core chapters on hours of sunshine, shadow or terrain are missing or empty, (c) a data source is demonstrably faulty and, as a result, a map or the sun or shadow calculation is obviously wrong, for example because a neighbouring building is in the wrong place in the official model, or (d) the report cannot be opened for technical reasons.
Money back: If rectification is not possible, for example because the necessary data for the address is missing or an error in the official data cannot be corrected, or if we cannot fix a technical error under (d) within 5 working days, we refund the amount paid.
No defect exists if the result merely does not meet expectations, for example less sun or more shadow than hoped; if individual additional maps or chapters based on third-party data are missing or limited (clause 9); if new buildings, conversions or trees since the data date of the official sources are only shown in simplified form or not at all (clause 6); if the report does not provide a valuation or legal or building information (clause 6); or if the wrong address was ordered. In these cases, there is no entitlement to rectification or a refund.
For subscriptions, we likewise rectify the report; if that is not possible, we credit the affected report back to the quota. The subscription fee is not refunded for this. Refunds are made to the original payment method.
We strive for uninterrupted operation but do not guarantee it; geodata services of the Confederation and third parties may be temporarily unavailable. Where possible, we announce maintenance windows in advance. Downloaded reports open without an account and without logging in; when opened, they load maps and geodata from the federal geodata services and from our server. If these cease to be available, individual parts may be missing.
Third-party data sources: The reports are based on geodata of the Confederation, the cantons and other third parties (clause 6). These bodies may change, restrict, start charging for or withdraw their data at any time; we have no influence over this and are not answerable for it. If an individual dataset ceases to be available or is restricted, for example a canton’s hazard map, the chapter concerned is omitted or created with the remaining data; the other services remain unchanged. This does not give rise to any claim to a price reduction, replacement delivery or damages. The address checker on the website shows which data is available for an address before you buy.
Loss of essential data: If, due to the loss or restriction of data sources, we can no longer provide a subscription in its essential parts (in particular the terrain, building and sun calculations), the subscription ends on the day on which the data is no longer available. We inform you by email and settle the current period to the day up to that date; we refund the remainder in accordance with clause 5. There are no further claims, to the extent permitted by law. Single reports already delivered are not affected. If an ordered single report cannot be created due to missing data, clause 2 applies: we refund the amount paid in full.
We are liable without limitation for intent and gross negligence and insofar as the law mandatorily provides for liability.
Private customers: In the case of slight negligence, our liability is limited to the amount you paid for the service concerned. Consequential damage, lost profit and financial losses arising from decisions you make on the basis of the report are excluded, to the extent permitted by law.
Subscription customers (companies and businesses): Liability for slight negligence is excluded. Otherwise, it is limited to the fees paid for the subscription concerned in the last 12 months. Consequential damage, lost profit and data loss are excluded.
We are not liable for errors, gaps and changes in third-party data (the Confederation, the cantons, OpenStreetMap and other data suppliers under clause 6); these bodies are not our auxiliary persons, and we cannot verify their data (clauses 6 and 9). For auxiliary persons such as hosting and payment service providers, we are only liable insofar as we are at fault in selecting or instructing them (Art. 101 para. 2 CO).
The processing of personal data is described in the privacy policy.
Swiss law applies. For private customers, the statutory places of jurisdiction apply (Art. 32 CPC); for business customers, the place of jurisdiction is the registered office of the provider. We may amend these terms; for ongoing subscriptions, the new version applies from the next billing period, and we inform you by email beforehand. Should any provision be invalid, the remainder of the terms remains valid. These terms are available in German, French, Italian and English; in case of discrepancies, the German version prevails.
